Washington Updates

Update on the government shutdown
For most of September, Congress was focused on considering a budget for 2014 before the 2013 fiscal year ended on September 30th. Congress, however, has failed to pass a budget or a Continuing Resolution (CR) and, thus, all nonessential government services shut down. As Congress struggles to resolve the FY 2014 impasse, the next budget battle looms. The government is projected to reach its borrowing limit on October 17. Any bill to fund the government has to be agreed on by both chambers and signed by the President in order to reverse the government shutdown.

MSHA news
MSHA outlines mine safety plans in light of government shutdown
MSHA is keeping 41 percent of its workforce of 2,355 on the job during the government shutdown to provide essential safety services to the industry. MSHA employees will be used to continue impact inspections. Hazard-specific inspections aimed at conditions and practices that have led to recent mine fatalities and serious injuries will continue, as well as investigations into accidents and miners' safety complaints. To support these activities, a minimal level of supervisory staff will be maintained at all of MSHA's district and field offices. MSHA also said it would continue to perform certain plan reviews and approvals, provide information technology support, maintain a minimal emergency response presence and provide security at the Mine Academy and at its facility in Triadelphia, WV.

MSHA issues Miner’s Representative Guide
On Sept. 25, MSHA announced the availability of Miners’ Representative Guide, a comprehensive tool that expands upon the Guide to Miners’ Rights and Responsibilities released by the agency in June 2011. A miners’ representative is any person, group or organization designated by two or more miners to represent their interest during health and safety enforcement processes at their mine. According to the Mine Act, Congress specifically intended that a designated miners’ representative be included in many important aspects of mine safety and health such as traveling with and assisting federal inspectors, filing hazard complaints, participating in modification of mandatory safety standards and playing a role in litigation procedures under the Mine Act. The new guide provides detailed information about reporting hazardous conditions and imminent dangers, accident investigations, understanding the elements of discrimination, health and safety training, petitions for modification of a safety standard, rights to information and records, civil penalties and requests under the Freedom of Information Act.
